Kristin Cavallari and Jay Cutler reach temporary custody agreement after he files for divorce and asks for primary custody

Kristin Cavallari has found herself in the middle of a messy divorce while she isolates with her family.

The Very Cavallari star was recently ‘blindsided’ by husband Jay Cutler filing for divorce and asking for primary custody of their three children.

The couple has since made some progress in their divorce, coming up with a temporary child custody agreement as they adjust their living arrangements during quarantine.

A source told E! News: ‘They are now agreeing that Jay will allow Kristin to purchase the home she has been looking at since November of last year when they started having serious issues, which prompted her to start looking in the first place.’ 

They added: ‘In exchange for that, they are agreeing to split the time with their children, one week on and one week off. 

‘They are having the kids stay in the home and Kristin will stay a week, then Jay will stay a week.’

The children will switch between Cutler’s and Cavallari’s homes once she’s moved in to the new place, which the insider said she ‘should be able to close within a month.’

They added that ‘things between Jay and Kristin will probably get better once she is settled.’ 

The retired Chicago Bears quarterback, 37, surprise filed for divorce last week, after he and the Uncommon James founder, 33, had reportedly been working toward an amicable split.

Another source told E! News: ‘She had hoped they could work things out more amicably and they were off to a good start before Jay pulled the trigger.’

Although they originally decided to split custody 50/50, he stated in the filing that he was ‘the available at home parent and the primary caretaker of the parties’ minor children.’

The insider added: ‘His filing was basically trying to take her out of the equation so she had to respond strongly. She’s not going to be taken out of the equation when it comes to her children.’

Cavallari and Cutler tied the knot in June of 2013, and they share sons Camden, seven, Jaxon, six, and daughter Saylor, four.
